Marriage holds a deeply spiritual and sacramental significance within the Catholic Church and is governed by Canon Law. When a marital relationship has broken down, individuals may seek clarity not only under civil law, but also within the framework of the Church regarding their marital status and their ability to participate fully in sacramental life.
By contrast, Canadian Civil Law addresses marriage and its dissolution through legal processes such as divorce and, in limited circumstances, civil annulment. Civil annulments are rare and apply only where a marriage was legally invalid from the outset. Importantly, civil proceedings do not determine a person’s marital status within the Catholic Church. Questions of religious annulment are governed exclusively by Canon Law and are addressed through Church tribunals.
